1. Introduction
Welcome to the FastGig Rewards Feature ("Rewards Feature") for users in Singapore. These Terms and Conditions ("Rewards Terms") govern your participation in and use of the Rewards Feature offered by Fastco Pte. Ltd. and/or its related entities, affiliates, and subsidiaries (collectively, "Fastco Pte. Ltd.") in Singapore. By participating in the Rewards Feature, you agree to be bound by these Rewards Terms, which form part of the FastGig Website Conditions, including the Privacy Policy and, the Member Conditions and all terms incorporated herein (collectively, the "Agreement") without limitation or qualification. If you do not accept these Rewards Terms, you must refrain from using the Rewards Feature.
2. Eligibility
2.1. To participate in the Rewards Feature in Singapore, you must:
- Be a registered Member of FastGig with an active Account, as defined in the Website Conditions.
- Be at least 18 years old or, if under 18, have a parent or guardian agree to these Rewards Terms on your behalf, as outlined in Clause 1.1(b)(iii) of the Website Conditions.
- Hold a badge level of Bronze, Silver, or Gold, as outlined in the Ratings, Badges, Points, and Rewards framework for Singapore. Members with a "New" badge are not eligible to earn points until they achieve a Bronze badge or higher.
- Comply with all applicable Singapore laws and regulations, including those referenced in Clause 6.1(b) of the Website Conditions, such as the Protection from Online Falsehoods and Manipulation Act 2019 (No. 18 of 2019) and the Protection from Harassment Act (Cap. 256A).
- Fastco Pte. Ltd. reserves the right to determine in its sole discretion the eligibility of any individual as a Member without having to provide any reason whatsoever to the Member.
2.2. Fastco Pte. Ltd. reserves the right to verify your eligibility and may request additional information to ensure strict compliance with these Rewards Terms.
3. Earning Points
3.1. Points are earned based on completed shifts in Singapore, as defined in the Ratings, Badges, Points, and Rewards framework, and are determined by your current badge level:
- Gold Badge: 3 points per completed shift (minimum rating of 4.5, minimum of 45 shifts in the last 90 days).
- Silver Badge: 2 points per completed shift (minimum rating of 4.0, minimum of 20 shifts in the last 90 days).
- Bronze Badge: 1 points per completed shift (no minimum rating, minimum of 5 shifts in the last 90 days).
- New Badge: 0 points per completed shift.
3.2. Points are awarded only for shifts completed in accordance with FastGig’s policies. No points will be awarded for cancelled shifts, no-shows, or last-minute cancellations, as outlined in the FAQ.
3.3. If your badge level changes, the points earned per shift will adjust immediately for all future shifts, starting from the next shift after the badge upgrade or downgrade, as specified in the FAQ. Points accumulated prior to a badge change remain unaffected.
3.4 Points accumulated in your Account cannot be transferred or assigned to any other Member.
3.5. Points do not expire, as stated in the FAQ, but Fastco Pte. Ltd. reserves the right to modify this policy with prior notice, as per Clause 3.2 of the Website Conditions.
3.6 Points are automatically void upon termination of the Account, or when you cease to be a Member. Members shall not be entitled to any compensation in respect of any cancellation of Points by Fastco Pte. Ltd. pursuant to these Terms.
4. Redeeming Rewards
4.1 A Member may only redeem the Points after he/she has accumulated sufficient points in his/her Account and is eligible for such redemption, subject to fulfilling any terms and conditions as may be imposed by Fastco Pte. Ltd from time to time. The Points utilised for redemption shall be on a first-in-first-out basis.
4.2. Points can be exchanged for rewards available in FastGig’s Rewards Mall in Singapore, including but not limited to vouchers, gifts, and other items, as described in the FAQ.
4.3. To redeem a reward, you must access the Rewards Mall through the FastGig App or Site and follow the redemption process, which may include:
- Accessing a deeplink to a merchant’s portal.
- Using a voucher code provided in the "My Rewards" section of the App or Site.
4.4 Fastco Pte. Ltd reserves the right to adjust (whether by way of an increase or a decrease) the FastGig’s Rewards points required for redemption without any prior notice to the Members. All redemptions are subject to availability and change, and Fastco Pte. Ltd reserves the right to cancel, amend, substitute or remove any rewards or the terms of redemption without any prior notice to the Members.
4.5 All rewards are subject to availability and additional terms and conditions imposed by Fastco Pte. Ltd. or third-party merchants in Singapore, which will be made available at the time of redemption.
4.6 if the Member chooses to redeem their loyalty points through the Rewards Mall, these Terms will be applicable; and
4.7 if the Member chooses to redeem their loyalty points through the third-party merchants, the relevant terms and conditions of the third-party merchants will be applicable.
4.8. Rewards are non-transferable, non-exchangeable for cash, and non-refunded, except as required by Singapore law.
5. Reward Issues and Disputes
5.1. If a redeemed reward is not working or has expired, you may raise a dispute through the "My Rewards" section of the FastGig App or Site, as outlined in the FAQ.
5.2. Fastco Pte. Ltd. will investigate disputes and respond as soon as practicable. Resolutions may include, but are not limited to, providing a replacement reward or restoring points, at Fastco Pte. Ltd.’s sole discretion.
5.3. Fastco Pte. Ltd. is not responsible for issues arising from third-party merchants’ failure to honor valid rewards, but will make reasonable efforts to assist in resolving such disputes, as per Clause 7.4 of the Website Conditions.
5.4. Any decision made by Fastco Pte. Ltd under this paragraph 5.2 shall be final and binding.
6. Intellectual Property
6.1. All content related to the Rewards Feature, including but not limited to text, graphics, logos, and software, is the property of Fastco Pte. Ltd. or its licensors and is protected by Singapore Intellectual Property laws, as further outlined in Clause 5 of the Website Conditions.
6.2. You may not reproduce, modify, distribute, or otherwise exploitany content related to the without the prior written consent of Fastco Pte. Ltd., as specified in Clause 4.1 of the Website Conditions and applicable Singapore Intellectual Property Law
7. Access to Linked Sites
7.1. The Members may be able to access Linked Sites. Linked Sites are not reviewed, controlled, or examined by Fastco Pte. Ltd. in any way and Fastco Pte. Ltd. is not responsible for the content, availability, advertising, products or other materials of any such Linked Sites, or any additional links contained therein. These links do not imply Fastco Pte. Ltd.’s endorsement of, association, partnership or any other relationship with the Linked Sites and/or their operators. It is the sole responsibility of the Members to comply with the terms of service and privacy policy of the Linked Sites as well as with any other obligation under copyright, secrecy, defamation, decency, privacy, security and export laws related to the use of such Linked Sites and any content contained thereon. In no event shall Fastco Pte. Ltd. be liable, directly or indirectly, to anyone for any loss or damage arising from or occasioned by the creation or use of the Linked Sites or the information or material accessed through these Linked Sites. Any concerns should be directed to the relevant Linked Site’s administrator or webmaster. Fastco Pte. Ltd. reserves the exclusive right, at its sole discretion, to add, change, decline or remove, without notice, any link to any of the Linked Sites from the Application and/or introduce different links to different Members.
8. Prohibited Conduct
8.1. You agree not to:
- Manipulate or attempt to manipulate your ratings, badge level, or points through fraudulent or deceptive means.
- Not to share your password or allow any other person to access your Account, or otherwise do anything that may or will violate the security of your Account
- Use the Rewards Feature for any unlawful purpose or in violation of Singapore laws, as outlined in Clause 6.1(b) of the Website Conditions.
- Use automated processes, scripts, or bots to access or redeem rewards, as prohibited by Clause 6.1(d) of the Website Conditions.
- You will not transfer your Account to any other person without prior permission from Fastco Pte. Ltd.
- You are responsible for the use of your Account and all activities that are carried out through the Account, whether authorised or unauthorised and must immediately notify Fastco Pte. Ltd. if you become aware of any unauthorised use of or access to your Account.
8.2. Any violation of these prohibitions may result in the suspension or termination of your Account and/or access to the Rewards Feature, as per Clause 10.1 of the Website Conditions.
9. Disclaimers and Limitations of Liability
9.1 To the fullest extent permitted by law, Fastco Pte. Ltd. disclaims any liability whatsoever arising from or relating to the Member’s usage of the Application and/or participation in the Rewards Feature, howsoever arising, including but not limited to, the redemption and use of the rewards, any breakdown or malfunction in any computer system or equipment, any notice which is misdirected and/or lost in the post, loss of income, profits or goodwill, as well as any other direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties howsoever arising whether in contract, tort, negligence or otherwise.
9.2 Each Member assumes all risks and liabilities for loss or damage arising from his or her participation in the Rewards Feature.
9.3. The Rewards Feature is provided on an "as is" and "as available" basis, without warranties of any kind, as outlined in Clause 7.1 of the Website Conditions. Fastco Pte. Ltd. does not guarantee the availability, accuracy, or functionality of the Rewards Feature or any rewards.
- 9.4. To the fullest extent permitted by law, Fastco Pte. Ltd. shall not be liable for any claim, loss, damage, cost or expense incurred, suffered or sustained by the Member arising from or in connection with: The inability to redeem rewards due to technical issues, unavailability, or third-party merchant actions in Singapore.
- Any loss of data and records relating to the Member's Account or the Rewards FeatureErrors in point calculations or badge assignments, unless caused by Fastco Pte. Ltd.’s gross negligence.
- Any failure or inability of the Member to access the Application and/or his or her Account.Any indirect, special, consequential, or incidental damages, as specified in Clause 7.10 of the Website Conditions.
- (vii) For the avoidance of doubt, termination or suspension by Fastco Pte. Ltd. of the Rewards Feature shall not entitle any Member to any claim or compensation against Fastco Pte. Ltd. for any and all loss or damage suffered or incurred directly or indirectly as a result of such termination or suspension.
9.5. Fastco Pte. Ltd.’s aggregate liability for any claims related to the Rewards Feature shall not exceed S$50.00 or the total amount of fees paid by you for Services in the one-month period preceding the claim, whichever is lower, as per Clause 7.9 of the Website Conditions.
10. Modifications to the Rewards Feature
10.1. Fastco Pte. Ltd. reserves the right to change, modify, suspend, or discontinue the Rewards Feature in Singapore, in whole or in part, at any time without notice or liability, as per Clause 1.2 of the Website Conditions.
10.2. Any changes to these Rewards Terms will be posted on the FastGig Site or App, and continued use of the Rewards Feature after such changes constitutes acceptance of the amended terms, as per Clause 1.3 of the Website Conditions.
11. Termination
11.1. Fastco Pte. Ltd. may in its sole discretion, with reasonable prior notice to the Members, restrict, suspend, or terminate your access to the Rewards Feature in Singapore at its sole discretion, without notice, for reasons including but not limited to:
- Breach of these Rewards Terms or the Agreement.
- Fraudulent, harassing, or abusive behavior related to the Rewards Feature.
- Violation of Singapore laws, as outlined in Clause 10.1 of the Website Conditions.
11.2. Upon termination, all points and unredeemed rewards associated with your Account may be forfeited, and you will remain liable for any obligations incurred under these Rewards Terms, as per Clause 10.2 of the Website Conditions.
12. Indemnity
12.1. You agree to indemnify and hold Fastco Pte. Ltd. harmless from and against any and all claims, proceedings, loss, damage, costs and expenses (including legal costs on a full indemnity basis) incurred, suffered or sustained by each of the entities Fastco Pte. Ltd. and their respective directors, officers, employees, agents and contractors directly or indirectly arising from or relating to the Member’s participation in the Rewards Feature., as outlined in Clause 13 of the Website Conditions.
13. Collection, Use and Disclosure of Personal Data
13.1 The collection, use and disclosure of the Members’ personal data will be in accordance with the Fastco Pte. Ltd. Privacy Policy. By using his or her Rewards Feature or by logging into his or her Account, the Member shall be deemed to have read, understood and accepted the terms of Fastco Pte. Ltd. Privacy Policy.
14. Governing Law and Jurisdiction
14.1. These Rewards Terms shall be governed by and construed in accordance with the laws of Singapore, without giving effect to any principles of conflicts of law, including without limitation the Singapore Evidence Act (Chapter 97) and the Electronic Transactions Act (Cap. 88), as per Clause 21.1 of the Website Conditions.
14.2. By participating in the Rewards Feature, you submit to the non-exclusive jurisdiction of the Singapore courts, as per Clause 21.2 of the Website Conditions.
15. Entire Agreement
15.1 This is the entire agreement between you and Fastco Pte. Ltd. relating to the subject matter herein and shall not be modified.
16. Assignment
16.1 No rights of any Member against Fastco Pte. Ltd. under these Terms may be assigned or otherwise disposed of.
16.2 Fastco Pte. Ltd. may at any time assign or transfer all or any part of its rights and/or obligations under these Terms relating to any Account, Rewards Features without the prior consent of any Member.
17. Severability
17.1 If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
18. Remedies
18.1 No failure to exercise or delay in exercising any right, power or remedy under these Terms operates as a waiver. A single or partial exercise or waiver of the exercise of any right, power or remedy does not preclude any other or further exercise of that or any other right, power or remedy. A waiver is not valid or binding on the party granting that waiver unless made in writing.
19. Third Party Rights
19.1 Save as expressly stated otherwise, no third party shall have any right to enforce any provision of these Terms.
